[마이데일리 = 최나영 기자] 배용준, 전도연, 김태희, 권상우, 문근영 등 톱스타 66명이 초상권 침해 배상액을 전액 사회복지기관에 기부하기로 했다.

24일 서울고등법원 민사 13부(조용구 부장판사)에 따르면 연예인 66명은 초상권 침해 등으로 갈등을 빚었던 인터넷 사이트 '엔스닥'과의 소송에서 배상액을 받는 대신 이를 불우이웃돕기 성금으로 기부하는 조정안에 합의했다.

재판부는 사단법인 연예매니지먼트협회와 '엔스닥' 양측에 '엔스닥이 사이트에서 문제가 된 연예인들의 사진과 이름을 삭제하고, 12월부터 당사자 동의 없는 사진 사용을 금지하며 해당 연예인 66명의 이름으로 1000만원을 불우이웃돕기 기금으로 사회복지기관에 기탁한다'는 내용의 조정안을 제시했고, 양측은 이에 동의했다.

이로써 약 2년동안 진행돼 온 톱스타 66명과 인터넷 사이트 간의 법정 공방은 '불우이웃에 온정 전하기'로 순조롭게 막을 내렸다.

지난해 3월 연예인 66명은 자신들을 일종의 가상 회사(사적인 거래 대상)로 보고 증권시장과 유사하게 주식거래를 하는 인터넷 사이트 '엔스닥'을 상대로 초상권, 성명권 등 사용금지 청구소송을 냈다. 연예인들은 총 7억 7600만원을 지급할 것과 자신들의 이름과 사진을 사용하지 말 것을 요구했다.

하지만 '엔스닥'측은 인격권 침해가 아니라며 이에 불복해 항소했다가 항소심에서 이 같은 조정안에 합의했다. 엔스닥 측은 12월 31일까지 한국연예매니지먼트협회가 지정하는 사회복지기관에 불우이웃돕기 성금 1000만원을 기탁할 예정이다.
