Abstract:

On April 3rd, around 11pm, Korean-American Edward Lee and the son of an U.S. military officer Arthur Patterson stabbed to death Cho Joong Phil in the bathroom of a Burger King restaurant. Arthur Patterson and Edward Lee had been hanging out at the Burger King with friends. They had been playing with a jack knife when Edward Lee said to Arthur Patterson, “I’ll show you something” then proceeded to follow Cho Joong Phil into the bathroom. Then Edward Lee stabbed him to death while Patterson held him down. Then, they came out and put on their friends’ shirts and caps, and walked out. As they walked out, they said to their friends, ”We played a bloody game. We killed, for fun.” On April 26th, Edward Lee was convicted of murder and Arthur Patterson was convicted of assault.

Prosecutors have reopened their investigation into the “Itaewon Murder Case” also referred to as the “Burger King Murder” of 1997.

The Seoul Central District Prosecutor‘s Office Department of Foreign Affairs has asked the U.S. Justice Department to extradite Arthur Patterson, age 32 and the prime suspect in the murder case. The Justice Ministry also said on Tuesday “We will ask U.S. government to extradite Patterson according to the request of prosecutors.”

On April 3 in 1997, a then-university student 23-years old with the surname of Cho was killed in a stabbing in the restroom of a Burger King in Itaewon. At the time, there were two suspects, including Arthur Patterson and his friend Edward Lee who followed Cho into the restroom. The U.S. Army Criminal Investigation Command named Patterson as its prime suspect while South Korean prosecutors indicted Edward Lee due to lie detector results and on the basis of an expert opinion by a forensic doctor. Prosecutors charged Patterson with the possession of weapon.

Seoul’s High Court found Lee guilty and sentenced him to twenty years in prison, however, the Supreme Court reversed the verdict and found him innocent because it could not find credibility in Patterson’s statement. Since Patterson returned to the U.S. after being released by South Korean authorities, prosecutors have been unable to continue with their investigation.

Some speculate the release of the film about the murder case, “Where the Truth Lies,” has fueled public pressure on prosecutors to re-open the case and formally inform U.S. authorities of their desire to further question Patterson.

Meanwhile, many worry that there are obstacles facing the investigation as the statute of limitations is three years, and extradition might take up to a year alone following a trial in the U.S.

Summary of Incident and Trial (Translated, edited April 30, 2008)

At 11 pm on the evening of April 3, 1997, Hong-ik University student Jung-pil Cho was found dead in the restroom of a Burger King in Itaewon, Seoul. He had been stabbed 9 times in the chest and neck. The U.S. Army Criminal Investigation Command (CID) received a report of the incident and began preliminary investigations and questioning the primary suspect, Arthur Patterson, son of a U.S. military service member. These preliminary investigations revealed that both Arthur Patterson and Edward Lee, Korean-American civilian, were at the scene of the crime when the incident occurred. Witnesses’ testimonies collected by the CID revealed that Patterson was a member of the Norte 14 gang in the U.S., and that Patterson himself was heard stating that he killed someone the same evening. CID investigations clearly indicated that Patterson was the primary suspect for Cho’s homicide, and the case (Patterson) was transferred to South Korean law enforcement officials.

Several days after the homicide occurred, Edward Lee turned himself into Korean authorities, at which point a full-fledged criminal investigation began. The prosecution and Korean authorities carried out their investigation and brought charges against Edward Lee as the culprit of the homicide and Arthur Patterson as an accomplice to the crime. In contradiction with the evidence they collected, U.S. officials did not challenge the prosecutor’s charges.

During the trial, both defendants denied all charges and placed blame of Jung-Pil Cho’s death on one another. In addition, inconsistencies emerged in the accounts given by Randy, a friend of Arthur Patterson. When CID questioned Randy during the preliminary investigation, he stated that Patterson admitted to killing Cho. When questioned by the Korean prosecution during trial, however, Randy changed his testimony and denied that Patterson made such statements. Randy’s testimony was thus rendered unreliable/incredible and the prosecution relied on autopsy and lie detector results. On April 26, 1997, Edward Lee was convicted of murder and Arthur Patterson was convicted of possession of a deadly weapon and destruction of evidence.

On October 2, 1997, judges sentenced Lee to life imprisonment and Patterson to 1 year and 6 months in prison with a 1 year stay of execution. Both men appealed the sentences and on January 26, 1998 and Lee’s sentenced was reduced to 20 years in prison, while Patterson’s remained 1 year, 6 months with a 1 year stay. Later, Patterson abandoned his appeal case and was released from prison on August 15, 1998 with a special pardon. Lee’s case was appealed in Seoul Higher Appellate Courts, and then in the Supreme Court. As a result of the Supreme Court trial, which concluded on September 3, 1999, Lee was cleared of all charges due to insufficient evidence and released from prison.

After Edward Lee was cleared of all charges on September 24, 1998 in Seoul Appellate Courts (before the Supreme Court trial) Jung-Pil Cho’s bereaved family members brought a complaint against Arthur Patterson for Cho’s murder and demanded that he be immediately retained for further examination and collection of evidence.

After Patterson was released from jail, he could not leave the country due to prosecutor’s request. However, the prosecution failed to apply in the allotted time for an extension of the order that would prohibit Patterson from leaving the country. The prosecutor applied two days late, and Patterson returned to the United States while the Supreme Court was still deliberating Lee’s appeal. When Lee’s trial ended and judges determined he was not guilty of murder (leaving Patterson as the primary suspect for first-degree murder), Patterson was already back in the U.S. It was later revealed that he left Korea in December of 1999.

As a result, the case has not been put to rest. There are currently no convictions for the murder of Jung-Pil Cho and no one has been held responsible for his brutal death.

What are the underlying reasons for this ambiguous, absurd result? First, the vital evidence collected during CID’s preliminary investigation did not maintain credibility due to contradictions between accounts from the Korean authorities’ investigation and the U.S. Army’s investigation. Therefore, the CID-collected eyewitness accounts (in which Patterson’s friend stated that he admitted to the murder of Cho) could not be used by the state prosecutor during the trial. SOFA (Status of Armed Forces Agreement) regulations hindered the South Korean court’s ability to summon key witnesses that were dependents/children of U.S. military soldiers to be questioned in court by the prosecutor. In addition, logistical issues such as translation and interpretation (during interviews, etc.) complicated the prosecution’s investigations and disabled a smooth examination process.

In November of 2000 and again in January of 2002, the Seoul district public prosecutor sent the U.S. Department of Justice request for cooperation in order to proceed with criminal investigations: to gain access to witnesses and Patterson, the primary suspect. However, the prosecution did not receive a reply from U.S. officials, and have since then virtually stopped legal proceedings. In the case of murder, the statute of limitations in 15 years, within which time Patterson may be detained and punished for the crime. Instead, Patterson has fled Korea and public prosecutors have failed to get the cooperation of U.S. officials to continue the investigation and in reality, real efforts to close the case have been abandoned. The efforts and legal proceedings to bring justice to the murderer of Jung-Pil Cho have made minimal advancements. Instead, his death has become a solvable, “unsolved mystery.”

Perhaps as a result of the movie that came out in September, The Hankyoreh reports the infamous crime in the old Itaewon Burger King may become a live case again.

After 12 years prosecutors are re-investigating the "Itaewon Burger Shop Murder", which has remained unsolved since 1997.

The foreign affairs division of the Seoul prosecutors office has requested the extradition of 32-year old murder suspect Arthur Patterson. The Ministry of Justice also announced on the 15th that, "following the request of the prosecutor's office we plan to request the American government to extradite Peterson."

On the night of April 3rd, 1997, 23-year old college student Mr. Jo was stabbed to death in the bathroom of a hamburger store in Itaewon-dong, Yongsan-gu, Seoul. Suspicion fell on the American Patterson and his friend Edward Lee, both of whom had followed Mr. Jo into the bathroom. At the time the military investigation team focused on Patterson as the most likely suspect. But prosecutors, acting on the results of a lie detector test and the theories of experts, indicted Lee for the crime and accused Patterson of merely possessing the weapon and destroying evidence. Lee was sentenced to 20 years in prison on appeal, but the Supreme Court pronounced him not guilty, saying "the statements of Patterson, who was with Lee, lack credibility." By then it had been over a year and Patterson had returned to America after receiving an August 15th special pardon. Though it was clear that either Lee or Patterson had stabbed Mr. Jo, Patterson, most likely the true killer, was in America and could not be investigated further. Prosecutors belatedly sought people who had seen Patterson and requested cooperation from American authorities but without result, and the investigation of Patterson came to an end.

Prosecutors said that they re-opened the investigation after the September release of the film "The Case of Itaewon Homicide" (이태원 살인사건), based on the events of the murder, caused a clamor to catch the true killer. But it appears it will not be easy to punish Peterson even though three years remain under the statute of limitations. Even if Patterson were arrested in America, it would take over a year to transfer him to Korea. It appears there would have to be a change in the attitude of the American government towards protecting its citizens.

Synopsis / Plot

Based on an unsolved murder case at a Burger King hamburger fast-food chain in Seoul’s multicultural Itaewon district in 1997, “The Case of Itaewon Homicide” opens with a graphically brutal scene in which an innocent college student is stabbed to death by a stranger.

Two Korean-American teenagers, Pearson (Jang Geun-seok) and Alex (Sin Seung-hwan), are the prime suspects in custody, and each blames the other for the horrific crime. In the movie, Jang Keun-Suk plays one of two Korean-American teenagers who are the main suspects in a killing occurring in an Itaewon fast-food restaurant. Both young men point the finger at the other for the killing a Korean university student, and the thriller unfolds as a detective (Jung Jin-young) tries to uncover what really happened. This casting differs slightly from the true case upon which the movie is based, which occurred twelve years ago in April of 1997 and has never been entirely resolved. The real case involved 17-year-old American Arthur Patterson and 18-year-old Korean-American Edward Lee, who were let go after a “bungled prosecution,” after which Patterson fled to the U.S. and Lee was acquitted by the Supreme Court.

According to a source with the film production, this story differs from other murder-thriller movies like Memories of Murder or Voice of a Murder in which authorities pursue an unknown killer. In Itaewon Murder Case, the two suspects are already in custody, and police must decide which is the true culprit.

Itaewon Murder Case also stars actors Shin Seung-hwan, Go Chang-seok, Oh Kwang-rok, and Triple’s resident cutie Song Joong-ki. It is planning for a September release.

Summary of Incident and Trial (Translated, edited April 30, 2008)

At 11 pm on the evening of April 3, 1997, Hong-ik University student Jung-pil Cho was found dead in the restroom of a Burger King in Itaewon, Seoul. He had been stabbed 9 times in the chest and neck. The U.S. Army Criminal Investigation Command (CID) received a report of the incident and began preliminary investigations and questioning the primary suspect, Arthur Patterson, son of a U.S. military service member. These preliminary investigations revealed that both Arthur Patterson and Edward Lee, Korean-American civilian, were at the scene of the crime when the incident occurred. Witnesses’ testimonies collected by the CID revealed that Patterson was a member of the Norte 14 gang in the U.S., and that Patterson himself was heard stating that he killed someone the same evening. CID investigations clearly indicated that Patterson was the primary suspect for Cho’s homicide, and the case (Patterson) was transferred to South Korean law enforcement officials.

Several days after the homicide occurred, Edward Lee turned himself into Korean authorities, at which point a full-fledged criminal investigation began. The prosecution and Korean authorities carried out their investigation and brought charges against Edward Lee as the culprit of the homicide and Arthur Patterson as an accomplice to the crime. In contradiction with the evidence they collected, U.S. officials did not challenge the prosecutor’s charges.

During the trial, both defendants denied all charges and placed blame of Jung-Pil Cho’s death on one another. In addition, inconsistencies emerged in the accounts given by Randy, a friend of Arthur Patterson. When CID questioned Randy during the preliminary investigation, he stated that Patterson admitted to killing Cho. When questioned by the Korean prosecution during trial, however, Randy changed his testimony and denied that Patterson made such statements. Randy’s testimony was thus rendered unreliable/incredible and the prosecution relied on autopsy and lie detector results. On April 26, 1997, Edward Lee was convicted of murder and Arthur Patterson was convicted of possession of a deadly weapon and destruction of evidence.

On October 2, 1997, judges sentenced Lee to life imprisonment and Patterson to 1 year and 6 months in prison with a 1 year stay of execution. Both men appealed the sentences and on January 26, 1998 and Lee’s sentenced was reduced to 20 years in prison, while Patterson’s remained 1 year, 6 months with a 1 year stay. Later, Patterson abandoned his appeal case and was released from prison on August 15, 1998 with a special pardon. Lee’s case was appealed in Seoul Higher Appellate Courts, and then in the Supreme Court. As a result of the Supreme Court trial, which concluded on September 3, 1999, Lee was cleared of all charges due to insufficient evidence and released from prison.

After Edward Lee was cleared of all charges on September 24, 1998 in Seoul Appellate Courts (before the Supreme Court trial) Jung-Pil Cho’s bereaved family members brought a complaint against Arthur Patterson for Cho’s murder and demanded that he be immediately retained for further examination and collection of evidence.

After Patterson was released from jail, he could not leave the country due to prosecutor’s request. However, the prosecution failed to apply in the allotted time for an extension of the order that would prohibit Patterson from leaving the country. The prosecutor applied two days late, and Patterson returned to the United States while the Supreme Court was still deliberating Lee’s appeal. When Lee’s trial ended and judges determined he was not guilty of murder (leaving Patterson as the primary suspect for first-degree murder), Patterson was already back in the U.S. It was later revealed that he left Korea in December of 1999.

As a result, the case has not been put to rest. There are currently no convictions for the murder of Jung-Pil Cho and no one has been held responsible for his brutal death.

What are the underlying reasons for this ambiguous, absurd result? First, the vital evidence collected during CID’s preliminary investigation did not maintain credibility due to contradictions between accounts from the Korean authorities’ investigation and the U.S. Army’s investigation. Therefore, the CID-collected eyewitness accounts (in which Patterson’s friend stated that he admitted to the murder of Cho) could not be used by the state prosecutor during the trial. SOFA (Status of Armed Forces Agreement) regulations hindered the South Korean court’s ability to summon key witnesses that were dependents/children of U.S. military soldiers to be questioned in court by the prosecutor. In addition, logistical issues such as translation and interpretation (during interviews, etc.) complicated the prosecution’s investigations and disabled a smooth examination process.

In November of 2000 and again in January of 2002, the Seoul district public prosecutor sent the U.S. Department of Justice request for cooperation in order to proceed with criminal investigations: to gain access to witnesses and Patterson, the primary suspect. However, the prosecution did not receive a reply from U.S. officials, and have since then virtually stopped legal proceedings. In the case of murder, the statute of limitations in 15 years, within which time Patterson may be detained and punished for the crime. Instead, Patterson has fled Korea and public prosecutors have failed to get the cooperation of U.S. officials to continue the investigation and in reality, real efforts to close the case have been abandoned. The efforts and legal proceedings to bring justice to the murderer of Jung-Pil Cho have made minimal advancements. Instead, his death has become a solvable, “unsolved mystery.”

On April 3rd, around 11pm, Korean-American Edward Lee and the son of an U.S. military officer Arthur Patterson stabbed to death Cho Joong Phil in the bathroom of a Burger King restaurant. Arthur Patterson and Edward Lee had been hanging out at the Burger King with friends. They had been playing with a jack knife when Edward Lee said to Arthur Patterson, “I’ll show you something” then proceeded to follow Cho Joong Phil into the bathroom. Then Edward Lee stabbed him to death while Patterson held him down. Then, they came out and put on their friends’ shirts and caps, and walked out. As they walked out, they said to their friends, ”We played a bloody game. We killed, for fun.” On April 26th, Edward Lee was convicted of murder and Arthur Patterson was convicted of assault.

Prosecutors have reopened their investigation into the “Itaewon Murder Case” also referred to as the “Burger King Murder” of 1997.

The Seoul Central District Prosecutor‘s Office Department of Foreign Affairs has asked the U.S. Justice Department to extradite Arthur Patterson, age 32 and the prime suspect in the murder case. The Justice Ministry also said on Tuesday “We will ask U.S. government to extradite Patterson according to the request of prosecutors.”

On April 3 in 1997, a then-university student 23-years old with the surname of Cho was killed in a stabbing in the restroom of a Burger King in Itaewon. At the time, there were two suspects, including Arthur Patterson and his friend Edward Lee who followed Cho into the restroom. The U.S. Army Criminal Investigation Command named Patterson as its prime suspect while South Korean prosecutors indicted Edward Lee due to lie detector results and on the basis of an expert opinion by a forensic doctor. Prosecutors charged Patterson with the possession of weapon.

Seoul’s High Court found Lee guilty and sentenced him to twenty years in prison, however, the Supreme Court reversed the verdict and found him innocent because it could not find credibility in Patterson’s statement. Since Patterson returned to the U.S. after being released by South Korean authorities, prosecutors have been unable to continue with their investigation.

Some speculate the release of the film about the murder case, “Where the Truth Lies,” has fueled public pressure on prosecutors to re-open the case and formally inform U.S. authorities of their desire to further question Patterson.

Meanwhile, many worry that there are obstacles facing the investigation as the statute of limitations is three years, and extradition might take up to a year alone following a trial in the U.S.

Perhaps as a result of the movie that came out in September, The Hankyoreh reports the infamous crime in the old Itaewon Burger King may become a live case again.

After 12 years prosecutors are re-investigating the "Itaewon Burger Shop Murder", which has remained unsolved since 1997.

The foreign affairs division of the Seoul prosecutors office has requested the extradition of 32-year old murder suspect Arthur Patterson. The Ministry of Justice also announced on the 15th that, "following the request of the prosecutor's office we plan to request the American government to extradite Peterson."

On the night of April 3rd, 1997, 23-year old college student Mr. Jo was stabbed to death in the bathroom of a hamburger store in Itaewon-dong, Yongsan-gu, Seoul. Suspicion fell on the American Patterson and his friend Edward Lee, both of whom had followed Mr. Jo into the bathroom. At the time the military investigation team focused on Patterson as the most likely suspect. But prosecutors, acting on the results of a lie detector test and the theories of experts, indicted Lee for the crime and accused Patterson of merely possessing the weapon and destroying evidence. Lee was sentenced to 20 years in prison on appeal, but the Supreme Court pronounced him not guilty, saying "the statements of Patterson, who was with Lee, lack credibility." By then it had been over a year and Patterson had returned to America after receiving an August 15th special pardon. Though it was clear that either Lee or Patterson had stabbed Mr. Jo, Patterson, most likely the true killer, was in America and could not be investigated further. Prosecutors belatedly sought people who had seen Patterson and requested cooperation from American authorities but without result, and the investigation of Patterson came to an end.

Prosecutors said that they re-opened the investigation after the September release of the film "The Case of Itaewon Homicide" (이태원 살인사건), based on the events of the murder, caused a clamor to catch the true killer. But it appears it will not be easy to punish Peterson even though three years remain under the statute of limitations. Even if Patterson were arrested in America, it would take over a year to transfer him to Korea. It appears there would have to be a change in the attitude of the American government towards protecting its citizens.

Finally, there’s an effort to reinvestigate the 12-year-old case of “Itaewon Murder”. I don’t know it can be possible or not, because it’s really long time. But at least this effort can restore the feeling of the victim’s family, I think. I feel really sad with the victim & his family after finished with this movie. That innocent boy had to die in vain. In this case, really grateful for the production team of this movie, to stir public attention in this case. I had to say “GREAT JOB!” for all of you. And of course, you too, Jang Keun-suk, to be a part of this project (and you’re really look like a murderer…haha).^^

Prosecutors Trying to Extradite Prime Suspect Arthur Patterson

It's been classified as a cold case for a decade, but now, the so-called "Itaewon murder" is up for reinvestigation. Prosecutors' efforts to extradite the prime suspect in the 12-year-old case, Arthur Patterson, from the United States, will hinge on the cooperation of the U.S. State Department.

The prosecution has decided to reinvestigate the homicide in Itaewon, Seoul, involving two teenagers as suspects - a Korean-American and the child of an American soldier - back in 1997.

The former, Edward Lee, was acquitted by the Supreme Court, while the other suspect, Patterson, fled to the U.S.

The Ministry of Justice said Tuesday the Seoul Central District Prosecutors' Office recently asked it to coordinate with U.S. authorities to extradite Patterson.

Kim Hae-woong, spokesman for the ministry, confirmed the prosecution's request, but refused to elaborate. "It will take some time before making an official request to the U.S. government for extradition," the spokesman told The Korea Times.

Lee Heung-rak, a justice ministry official familiar with the matter, said: "Our role will be just translating the concerned documents into English and delivering them to our counterpart via the foreign ministry. Whether or not to return the suspect to Seoul will be determined by the U.S. government."

The official did not rule out the possibility that the American government will reject the request, citing "double jeopardy."

Patterson was found guilty in 1998 on charges of possessing an illegal weapon that was apparently used in the crime and destruction of evidence. Imprisoned for about eight months, he was released on Aug. 15, 1998 on a special pardon.

At the time of being released, Patterson was accused by the prosecution of killing Cho Joong-pil, aged 22.

However, he fled to the U.S. in 1999 after prosecutors failed to renew a travel ban imposed on him.

"To avoid double jeopardy and getting the extradition agreed to, the U.S. government will have to recognize the prior conviction as independent of the murder charge," a judge at the Seoul Central District Court said. "But if they regard the possession as an act in line with the murder and thus conclude the two constitute a single crime, the request could be rejected."

Though the case has, since Patterson's departure, remained pending with the prosecution, the crime has virtually vanished from people's memory.

A recent movie based on the tragic story brought public attention back to the unresolved crime, encouraging the prosecution to reopen the case.

On April 3, 1997, one of the two teenagers stabbed Cho, a college student, in a franchise restaurant in Itaewon.

Initially, Patterson was indicted for possessing the weapon and Lee for stabbing the Korean to death.

Upholding a lower court decision, an appellate court sentenced Lee to 20 years in prison in January 1998, but the Supreme Court ordered the appellate court to review the case, citing a lack of evidence. In respect to the ruling, the appellate court later acquitted Lee.

Ahead of that ruling, the prosecution indicted Patterson on the charge of homicide, but its carelessness in extending a travel ban imposed on him made it possible for him to flee to his home country.

The movie, which drew more than 300,000 viewers, also fueled a stereotype harbored by some Koreans that Americans related to U.S. troops in South Korea are not duly punished for crimes they commit on Korean territory.

This antagonism first erupted following the accidental deaths of two Korean girls - Shim Mi-sun and Shin Hyo-soon - in 2002 after they were struck by a U.S. armored vehicle.

`이태원 살인사건' 재수사

검찰이 진범을 가리지 못하고 미제로 남은 서울 `이태원 햄버거 가게 살인사건'을 12년 만에 재수사한다.

법무부는 서울중앙지검 외사부의 요청에 따라 유력 용의자로 의심됐던 아더 패터슨 씨에 대해 미국에 범죄인 인도를 청구할 예정이라고 15일 밝혔다.

1997년 4월 서울 용산구 이태원 햄버거가게 화장실에서 대학생 조모 (사망당시 23세)씨가 흉기에 찔려 숨진 뒤 현장에 있었던 패터슨 (당시 18세)씨와 에드워드 리 (당시 18세)씨가 용의선상에 올랐지만 살인죄로 기소된 리씨는 1999년 무죄가 확정됐다.

흉기 소지 등의 혐의로 기소된 패터슨 씨는 징역형을 선고받은 후 사면을 받고 같은 해 수사 검사가 출국정지 연장을 하지 않은 틈을 타 미국으로 출국했으며 법원은 피해자 조 씨의 유족들이 사건의 진상을 규명할 기회를 사실상 박탈당했다며 국가가 3천400만원을 주라고 판결하기도 했다.

이에 따라 이태원 살인사건은 진범을 잡지 못한 채 일단락돼 검찰의 재수사로 사건의 실체가 밝혀질 수 있을지 주목된다.

대법원은 패터슨씨가 진범일 가능성이 있다고 보고 검찰이 살인죄로 기소한 리씨에게 무죄를 선고했으며 유족들이 패터슨씨를 고소해 수사가 재개됐지만 그가 출국해버리는 바람에 사건은 서울중앙지검에 계류돼있었다.

살인죄의 공소시효는 15년으로 아직 3년이 남았으며 미국에서 패터슨씨가 체포되더라도 인신보호 재판을 청구할 수 있기 때문에 송환까지는 상당기간이 걸릴 것으로 전망된다.

Making a film based on a true story definitely has its pros and cons. While reality and a solid plotline are largely guaranteed, people know the ending, leaving very little room to build suspense.


Based on an unsolved murder case at a hamburger chain in Seoul’s multicultural Itaewon district in 1997, “The Case of Itaewon Homicide” opens with a graphically brutal scene in which an innocent college student is stabbed to death by a stranger.

The killing shook the country that year, as local investigators failed to find the real killer, despite having two Korean-American suspects in custody who blamed one another. The hamburger shop eventually closed down, and frightened locals shunned the popular neighborhood for months.

As the movie shows, contradicting evidence and claims by the two suspects were enough to throw off the investigators, who still haven’t been able to solve the case. One of the suspects was declared not guilty by the court in 1998 for lack of evidence, and the other suspect left the country a year later. The investigation will officially close in April 2012 when the statute of limitations expires.

Retaining composure throughout, The Case of Itaewon Homicide dutifully tracks the investigation as the three main characters - two teenage suspects and a prosecutor - try to outwit one another in a mental battle.


Actor Jeong Jin-yeong in the role of the prosecutor as well as Jang Geun-seok and Shin Seung-hwan each pull off their respective parts, helping the audience understand why the investigators failed to nail down the killer.

What the movie does not do, however, is bring some spice to the story, a critical element in a story based on a true incident.

The movie naturally invites comparison with another film based on a real-life homicide that is also unresolved, “Memories of Murder” (2003). In that piece, director Bong Joon-ho managed to build up the suspense by adding drama.


In The Case of Itaewon Homicide, the actors put on a convincing performance. But their characters are somewhat plain and dull, not quite managing to bring viewers to the edge of their seats.

The film also fails to hit the bull’s eye on two aspects it should have put more focus on - the U.S. influence in the case and the role of the victim’s family.

Records show the case was complicated by the involvement of Korean-Americans, whom the U.S. protects as American nationals.
